2. Eligibility for LapelGuard.com purchases
Our Services are available only to individuals. Customer hereby represents and warrants that it is duly licensed to do business and is in good legal standing in the jurisdictions in which it does business (during the term of this Agreement); that it is not a competitor of LapelGuard.com; and that the person agreeing to this Agreement for Customer is at least eighteen (18) years of age and otherwise capable of and authorized to enter binding contracts for Customer.
3. Access
By accessing the LapelGuard.com website, you certify that you’re using premium content solely for personal, non-commercial purposes; you will not copy or distribute any part of the website without LapelGuard’s prior written authorization; you will fully comply with the terms and conditions of these terms of service as well as our acceptable use policy; and you will not share your account username and password with other persons.
4. Payment
By providing a credit card or other “Payment Method” accepted by LapelGuard for your purchase, you are expressly agreeing that we are authorized to charge you a one-time payment for Keenan’s Lapel Encyclopedia. When you provide a Payment Method to access a payment, our payment system will attempt to verify the information you entered. We do this by processing an authorization hold, which is standard practice. We do not charge you in connection with this authorization hold. If your Payment Method expires and you do not edit your Payment Method information or cancel your account, you authorize us to continue billing, and you will remain responsible for any uncollected amounts.
Rarely, if there are special circumstances where LapelGuard determines it is appropriate (e.g., your service is unavailable for days due to technical difficulties), we may provide refunds to affected subscribers. Please note that these are rare occassions, when the customer can prove he/she is unable to access content, despite having the appropriate hardware to handle the request.
4.1. Refunds
Due to the nature of this product, we reserve the right to not issue refunds after first access to the content. Purchases are final.
5. Intellectual Property Rights
You may not use, copy, reproduce, distribute, broadcast, display, sell, license, or otherwise exploit videos and or services for any other purposes without the prior written consent of LapelGuard.com. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offence.
You understand that when using the technique videos you will be exposed to a wide variety of technique, possibly from a variety of sources and that Lapel Guard is not responsible for the accuracy, usefulness, or safety of such technique. You hereby agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against LapelGuard with respect thereto, and agree to indemnify and hold Keenanonline and its owners, affiliates, and/or licensors harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

You agree that your use of the LapelGuard website shall be at your sole risk. To the fullest extent permitted by law, LapelGuard, its officers, directors, employees and agents disclaim all warranties express or implied, in connection with the website and your use thereof. Keenanonline makes no warranties or representations about the accuracy or completeness of the site’s content or the content of any sites linked to this site and assumes no liability or responsibility for any (I) errors, mistakes, or inaccuracies of content, (II) personal injury or property damage, of any nature whatsoever, resulting from access to and use of our website, (III) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (IV) any interruption or cessation of transmission to or from our website, (V) any bugs, viruses, Trojan horses or the like which may be transmitted to or through our website by any third party, (VI) and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Keenanonline website.

7.1. Medical Liability
LapelGuard provides videos which deal with the manipulation of one’s body. LapelGuard does NOT accept any liabilities for injuries or damages that may occur with the use of the website. As frequently stated, instructors on the website are not medical professionals, they provide instructions and advice based on their jiu jitsu practice and experiences. The customer must assess if the movements are appropriate for them to do, LapelGuard does not accept any responsibility for their actions.
8. General
These terms of service, together with the privacy policy and any other legal notices published on the LapelGuard website, shall constitute the entire agreement between you and LapelGuard. If any provision of these terms of service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms of service, which shall remain in full force and effect. No waiver of any term of this these terms of service shall be deemed a further or continuing waiver of such term or any other term, and LapelGuard failure to assert any right or provision under these terms of service shall not constitute a waiver of such right or provision. LapelGuard reserves the right to amend these terms of service at any time and without notice, and it is your responsibility to review these terms of service for any changes. Your use of Keenanonline following any amendment of these terms of service will signify your assent to and acceptance of its revised terms.
